1. Agreement to Terms

By downloading, installing, or using Health Stamp ("the App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Health Stamp is a mobile application for iOS and watchOS that allows users to add activity data from Apple HealthKit as captions to their photos. The App provides:

• Reading health and fitness data from HealthKit
• Generating activity captions for photos
• Writing IPTC metadata to photos
• Creating stamped copies of photos
• Apple Watch companion functionality

3. Eligibility

You must be at least 13 years old to use this App. By using the App, you represent and warrant that you meet this age requirement.

4. User Responsibilities

You are responsible for:

• Maintaining the security of your device
• All activity that occurs through your use of the App
• Ensuring you have the right to add captions to any photos you process
• Backing up your photos before using the App

5. Health Data

5.1 HealthKit Integration

The App integrates with Apple HealthKit to read your health and fitness data. By granting HealthKit access, you acknowledge that:

• The App reads data including steps, distance, cycling, swimming, and rowing metrics
• This data is used solely to generate photo captions
• You can revoke access at any time through iOS Settings

5.2 Not Medical Advice

Health Stamp is not a medical device and does not provide medical advice. The health data displayed is for informational and personal use only. Do not rely on this App for any health or medical decisions.

6. Photo Library Access

6.1 Permissions

The App requires access to your photo library to function. You grant the App permission to:

• Read photos and videos from your library
• Write caption metadata to photos
• Create new photo assets (stamped copies)

6.2 Your Content

You retain all ownership rights to your photos. The App does not claim any ownership or license to your content.

7. Subscriptions

7.1 Premium Features

Some features require an active subscription ("Health Stamp Pro"):

• Stamping photos from past days
• Additional premium features as added

7.2 Pricing and Billing

• Subscription: $6.99 USD per year
• Includes a 1-week free trial for new subscribers
• Payment is charged to your Apple ID account
• Subscription automatically renews unless cancelled at least 24 hours before the end of the current period

7.3 Managing Subscriptions

You can manage or cancel your subscription through your Apple ID account settings. See Apple's subscription management guide.

7.4 Refunds

All purchases are processed by Apple. Refund requests must be submitted to Apple in accordance with their refund policies.

8. Intellectual Property

8.1 App Ownership

Health Stamp, including its design, features, and code, is owned by Relipr and protected by intellectual property laws.

8.2 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8.3 Restrictions

You may not:

• Copy, modify, or distribute the App
• Reverse engineer or decompile the App
• Use the App for any unlawful purpose
• Remove any copyright or proprietary notices

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF HEALTH DATA

We do not warrant that:

• The App will be uninterrupted or error-free
• Defects will be corrected
• The App is free of viruses or harmful components

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL RELIPR BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of data, photos, or content
• Loss of profits or revenue
• Damages arising from your use or inability to use the App

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Relipr and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last Updated" date or posting notice within the App. Your continued use of the App after changes constitutes acceptance of the new Terms.

13. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for any reason, including violation of these Terms. Upon termination:

• Your license to use the App ends
• You must delete the App from your devices
• Provisions that by their nature should survive will remain in effect

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

1. Informal Resolution – Contact us first to attempt to resolve the dispute
2. Binding Arbitration – If informal resolution fails, disputes shall be resolved by binding arbitration

You waive your right to participate in class action lawsuits or class-wide arbitration.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Relipr regarding the App.

19. Apple-Specific Terms

As required by Apple for App Store distribution:

• These Terms are between you and Relipr, not Apple
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for any claims related to the App
• Apple is a third-party beneficiary of these Terms
